PRAYAGRAJ: The Allahabad High Court has intervened to help three siblings from a Muslim family who were expelled from a private school in Amroha district for allegedly bringing non-vegetarian food in their tiffin boxes.
Hearing a writ petition filed by the children’s mother, a division bench comprising Justice Siddhartha and Justice Subhash Chandra Sharma issued an order on December 17. The court directed the Amroha district magistrate to ensure the children are admitted to another CBSE-affiliated school within two weeks and to submit an affidavit confirming compliance. The court warned that failure to comply would require the district magistrate to appear in person at the next hearing scheduled for January 6.
According to the petition, the three siblings were expelled by the school’s principal in September 2024 after allegedly bringing non-vegetarian food in their lunch. The petitioners argued that this action disrupted the children’s right to education and had a deeply traumatic impact on their mental well-being, with potential long-term consequences.
The plea also contended that the school’s actions were discriminatory, violating the petitioners’ rights under Article 17 of the Constitution, as well as Sections 5 and 6 of the Protection of Civil Rights Act, 1955.
The court’s order seeks to provide immediate relief and ensure the children can continue their education without further disruption.
