The Navayuga Machilipatnam Port Limited (NMPL) filed an appeal petition challenging the single judge order upholding the GO issued by the state government cancelling the concession agreement entered with NMPL for the development of deep-water port at Machilipatnam. NMPL argued that the single judge did not consider the violations of contractual obligations by the state government while giving the judgement. Till the time the state government does not fulfil its contractual obligations of handing over the land and right of way to the project site, the question of launching works would not arise, but the same has not been considered by the single judge. NMPL sought interim relief seeking directions to the state government not to create any third party interests on the project pending disposal of the petition.
