In other news, a Constitution bench of the Supreme Court on Thursday highlighted the critical importance of fairness in arbitration, especially in cases involving the government and public sector undertakings (PSUs).
The court stressed that the government’s role should go beyond merely securing favorable outcomes, focusing instead on maintaining the integrity of the arbitration process.
The five-judge bench, led by Chief Justice of India Dhananjaya Y Chandrachud and including justices Hrishikesh Roy, PS Narasimha, JB Pardiwala, and Manoj Misra, warned against any attempts by PSUs to manipulate the arbitration process.
The bench is currently deliberating on whether one party to an arbitration can unilaterally appoint a panel of arbitrators while asking the other party to select from that panel, a practice that could undermine the fairness of the process.
